TERMS AND CONDITIONS OF USE – ARTESFERA Last updated: May 30, 2025 Welcome to ArtEsfera! These Terms and Conditions of Use ("Terms") govern your use of our digital platform, accessible through https://artesfera.tech, and establish the rights and obligations between you, the user, and ArtEsfera, a startup dedicated to applying cutting-edge technology to art and culture. By accessing or using the ArtEsfera platform, you agree to these Terms. If you do not agree, we recommend that you do not use our services. 1. PURPOSE ArtEsfera provides a platform with digital tools aimed at the professionalization of artists, including: • The AI assistant Daeva, which performs: o Analysis and explanation of contracts and cultural calls; o Practical support for project promotion (bio, pitch, messages); o Generation of launch plans and technical support; • Other services related to artistic career management and organization. 2. REGISTRATION AND ACCOUNT To use certain features, users must register on the platform by providing true, up-to-date, and complete information. You are responsible for the security of your account, including your password, and for all actions taken in your name. 3. PLATFORM USAGE By using ArtEsfera, you agree to: • Use the services in accordance with Brazilian law, especially the LGPD (Law No. 13.709/2018); • Not use the platform for illegal, abusive, discriminatory, or fraudulent purposes; • Respect intellectual property and third-party rights. 4. INTELLECTUAL PROPERTY All platform content, including the ArtEsfera brand, the AI Daeva, texts, images, code, and layouts, is owned by ArtEsfera or its partners and protected by copyright and industrial property laws. 5. LICENSE OF USE We grant you a limited, revocable, and non-exclusive license to use the platform, solely under these Terms. Any unauthorized use may result in civil and criminal penalties. 6. LIMITATION OF LIABILITY ArtEsfera is not responsible for: • Decisions made based on suggestions or content generated by the Daeva AI; • Temporary unavailability of the platform; • Damages caused by misinterpretation of calls or contracts processed by the AI; • Content generated by users or data provided by third parties. 7. PRIVACY AND DATA PROTECTION Your data is treated securely, in accordance with the LGPD. Practices are detailed in our Privacy Policy. ArtEsfera does not use user data to train the Daeva AI without formal consent registered in a specific document. We also do not share data with third-party AIs outside the scope of the platform and ArtEsfera’s data protection. 8. CANCELLATION AND SUSPENSION ArtEsfera may suspend or cancel accounts in case of misuse, fraud, or breach of these Terms. 9. CHANGES We may update these Terms at any time. Relevant changes will be communicated on the website or via email. 10. APPLICABLE LAW AND JURISDICTION These Terms are governed by Brazilian law.
